This agreement is between you and Byggsoft.no. By purchasing and using Byggsoft.no software, you understand and accept the following terms and conditions. If you do not accept all the terms and conditions of this agreement, or if you do not have the authority to accept all the terms and conditions of this agreement on behalf of the licensee, you must not use the software.

Account Terms & Conditions

• •Byggsoft.no accounts shall not be shared without our consent or distributed as works of another party. The software and calculators are all intellectual property of Byggsoft AS. Any breach of this will be considered a violation of copyright laws.
• •Byggsoft.no accounts are intended for one user only. You will experience lockouts or suspensions if the account is used simultaneously in two or more locations or on more than a predetermined number of devices or IP addresses per month. This is to protect against illegal use of Byggsoft.no products and software. If regular suspensions occur, extended lockouts and service availability may be suspended indefinitely or cancelled entirely.
• •All sales are final, and no refunds are given unless there are exceptional circumstances (e.g. if you never received the account or find a genuine error with it). Please read the detailed feature list for each product so you know exactly what you are purchasing before agreeing to pay. We offer grace periods (see next point) and money-back guarantees (point 7 below) on certain accounts. We do not offer refunds or trial periods to prevent people from using the software for their own benefit (potentially to complete assignments and homework) and then requesting a refund when they no longer need it.
• •Byggsoft.no offers a 30-day grace period for refunds of annual, recurring payments. Likewise, a 4-day grace period is available for refunds of monthly, recurring payments. The grace period starts at the time of the recurring charge. This is to protect users who have forgotten their subscription and are charged the subscription fee when they no longer use the service. For this refund to be granted, the user must not have used the product during the grace period and must contact Byggsoft.no customer support before the grace period expires.
• •Byggsoft.no reserves the right to make changes to the availability restrictions for free accounts and free software at any time, without notice.
• •Byggsoft.no offers a 30-day guarantee on certain products. If advertised, the user may request a refund if the product was not delivered as advertised, or if there have been serious problems with the software. The decision is made by Byggsoft.no customer support.
• •You may not rent, lease, sublicense, lend, or transfer the Product to another person or legal entity without written consent from Byggsoft.no.

Software & Usage Terms

• •Results from all engineering software should always be double-checked when used in real-world applications. As a Byggsoft.no user, it is your responsibility to verify and validate the software's results with other independent methods.
• •As a user of Byggsoft.no software, especially professional engineers, you agree to exercise sufficient duty of care when using Byggsoft.no's products. This includes not designing or constructing anything beyond your capabilities and knowledge as an engineer. As with all engineering software, one should always question the results and perform sufficient checks that the results are logical and correct. Byggsoft.no and its individual creators accept no responsibility for damages, liability, or consequences resulting from the use of our software.
• •A party shall not be liable for failure or delay in the performance of this agreement during the period such failure or delay is due to causes beyond the party's reasonable control, including but not limited to force majeure, war, strikes or labor disputes, embargoes, government orders, or other force majeure events.
• •The forces, materials, and results are all based on theoretical inputs and solutions. With any construction or design, a number of other factors can directly affect the actual results and behavior of said constructions. Some examples include other loads (e.g. wind), actual material properties, self-weight, age of the construction, etc. As a user, you understand that such variables can strongly alter the results of Byggsoft.no products from reality and should be taken into account in design and calculations.
• •There are literally millions of possible combinations of supports, connections, loads, members, materials, and sections. This makes it impossible to test and ensure accuracy in all possible scenarios. As with all software, there may be errors or bugs that cause it to malfunction. As a user, you understand that although all Byggsoft.no software undergoes extensive testing, the risk of deviating results due to software errors is still possible.
• •Results from Byggsoft.no shall not be used for design purposes unless approved by a professional and competent structural engineer.
• •You shall, at your own expense, defend and hold Byggsoft.no harmless from and with respect to losses or damages (including reasonable attorney's fees and costs) incurred in connection with any lawsuit or proceeding brought by a third party against Byggsoft.no to the extent such lawsuit or proceeding is based on (i) any claim arising from or related to your use of the Product, except where such claim asserts that the Software infringes or constitutes misuse of copyright, trade secret, patent, or trademark of a third party; or (ii) any claim arising from or related to any act or omission on your part. You shall pay any damages and costs awarded against Byggsoft.no (or paid or payable by Byggsoft.no under a settlement agreement) in connection with such lawsuit or proceeding.
• •Byggsoft.no reserves the right to use your structures and files as marketing material, only in the form of screenshots and visual media. To opt out of this, please contact us. Byggsoft.no will never release your designs or files to a third party or any other subscriber without your permission.
• •You agree to accept communications in the form of personal emails and marketing emails. You can unsubscribe from these at any time by clicking "Unsubscribe" at the bottom of the email or by contacting us.
• •Byggsoft.no may change the product automatically over time without notice and is not obligated to give you notice of such changes.

Privacy Policy

• •Byggsoft.no shall not distribute, share, or disclose personal information to third parties unless the use is solely for internal use by Byggsoft.no or the user has chosen to participate (for example, as part of a partnership program).
• •Byggsoft.no will never share data or information collected from third-party partners such as Microsoft, Autodesk, or Slack. This information shall only be used by Byggsoft.no to improve the user experience.
• •As a registered user, users agree that Byggsoft.no may use company name and logo with comments ("used by") for marketing purposes for a period of 18 months from registration or last date of subscription payment. Users may opt out of this at any time by emailing us at support@byggsoft.no.
• •Byggsoft.no reserves the right to request student information from the user at any time to verify the user's student status on a Byggsoft.no student account. This information is used solely to verify their student status and shall not be stored or shared.
• •When you create an account, we collect your email address and full name. These are the only personal data we collect. No usage analytics, device identifiers, or location data are collected.
• •Your email and name are collected solely for account management and authentication purposes — to identify you, let you log in, and associate your saved calculations with your account.
• •All data is transmitted over encrypted connections (TLS/HTTPS). Passwords are stored using industry-standard hashing and are never stored in plain text.
• •Your data is retained for as long as your account is active. You may request deletion of your account and all associated data at any time by visiting https://byggsoft.no/delete or by emailing post@byggsoft.no. Deletion requests are processed within 30 days.
• •This service is intended for professional engineers and is not directed at children under 18. We do not knowingly collect personal data from anyone under the age of 18.

Warranty Disclaimer

• •THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF CALCULATIONS. BYGGSOFT.NO DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT THE RESULTS OBTAINED FROM USE OF THE SOFTWARE WILL BE ACCURATE OR RELIABLE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU.

Limitation of Liability

• •TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BYGGSOFT.NO'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR THE USE OF THE SOFTWARE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO BYGGSOFT.NO IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
• •IN NO EVENT SHALL BYGGSOFT.NO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, STRUCTURAL DAMAGE, PERSONAL INJURY, PROPERTY DAMAGE, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE USE OR INABILITY TO USE THE SOFTWARE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF BYGGSOFT.NO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Governing Law & Jurisdiction

• •This agreement shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Any disputes arising out of or in connection with this agreement shall be resolved exclusively by Trondheim District Court (Trondheim tingrett) as the agreed legal venue.

Severability

• •If any provision of this agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Entire Agreement

• •This agreement constitutes the entire agreement between you and Byggsoft.no regarding the use of the software, and supersedes all prior or contemporaneous agreements, understandings, negotiations, and discussions, whether written or oral. No modification of this agreement shall be effective unless made in writing and signed by both parties.
